    Slightly different situations, but my father just passed away without a Will and it is a major headache for us kids left behind. From the surviour's point of view I can't tell how important a Will is. That said I need to go call a lawyer to get mine taken care of!!

    Argh-we've been talking about it before DS was born and still haven't gotten around to it. I think the biggest thing holding us back is that cannot decide who we want to pick as guardians.

    Definitely go through a lawyer. I *think* in CA that everything goes to probate automatically unless a trust is in place. We also paid $$$$ for ours, but it really is money well spent.

    We are just finishing up ours now. We created the trust, and are finishing transferring all the assets to it this week and next. It was much more complicated than I thought, and was really glad we hired an attorney to help us. It was pricey but worth it for the peace of mind.
