I agree that the things that frighten me most about Alito are his tendencies to try to legislate from the bench and his lack of respect for the rights of citizens.
While I agree that in general these are qualities I don't like in judges, are there decisions in particular that you see this displayed? I ask because many of the objections to Alito in the press are poorly presented or argued. I just don't buy the "he's allied with big business" or "he doesn't respect rights of the poor and disadvantaged" because, sure, you can find decisions in which he sided with the defendant in a Title VII action, but 9 times out of 10 it's entirely warranted, because under the jurisprudence the plaintiff, no matter how sympathetic, simply does not have enough evidence to succeed on his claim. I find it far more persuasive when people point to specific decisions.

I think Alito is going to be an awesome justice for the Supreme court. The thing that people have to remember is that the judges do not make the laws, they can only interpret the ones that currently exist, so it's not like Alito being confirmed is going to suddenly give him some crazy authority to just change every law he likes/doesn't like.
He received the highest rating from the Bar Association and is held in high regard by a number of his colleagues. Whether or not he was confirmed should be based solely on his abilities as a judge, and not on how he feels personally about issues.

Right-I'm sure the reason you're THIS excited about him is because of his credentials! I didn't realize you were such a legal scholar, LMC. So a Harvard-educated liberally inclined judge with the same record would get your equal support? Sure.
